Terms of Service - VMSS

## Overview

This website is operated by VMSS LTD (“we”, “us”, “our”). By accessing
vmss.co.uk and/or purchasing from us, you agree to these Terms of Service
(“Terms”) and the policies referenced in them, including our Returns,
Refunds & Right of Withdrawal Policy, Shipping Policy and Privacy Policy.

## Your statutory rights

**Nothing in these Terms excludes, limits or restricts the statutory rights
you have as a consumer**, including under the UK Consumer Rights Act 2015,
the Consumer Contracts Regulations 2013 and, for EU consumers, Directive
2011/83/EU and your national consumer law. This includes your 14-day right
to cancel distance purchases and your rights where goods are faulty, not as
described, or not fit for purpose. Where any clause of these Terms conflicts
with those rights, your statutory rights prevail.

If you are purchasing for business purposes, consumer protections do not
apply and these Terms apply in full as written.

## Eligibility

By using this website you confirm that you are legally capable of entering
into a binding contract and that you have read these Terms. Acceptance is
confirmed at checkout.

## Products

Our products are aftermarket and performance parts. They are not original
equipment (OEM) and are not affiliated with or endorsed by BMW AG. We may
modify or discontinue products, change specifications, limit quantities, or
decline an order (for example where we suspect fraud or where a pricing
error has occurred); if we cancel an order you have paid for, you receive a
full refund.

## Product variation

Aftermarket and electronic products can show minor variations in colour,
finish, brightness, timing or software behaviour, and performance can vary
with the vehicle, installation quality and environment. Minor variations of
this kind that do not affect the goods being of satisfactory quality, fit
for purpose and as described are not defects. This does not affect your
statutory remedies where goods genuinely fail to meet those standards, or
your 14-day right to cancel.

## Pricing and payment

Prices may change without notice. Payment must be completed in full before
dispatch. Where a clear pricing error has occurred we may cancel the
affected order and refund you in full.

## Shipping and delivery

Delivery estimates are set out on product pages and in our Shipping Policy.
Made-to-order carbon items carry longer lead times (typically 35–45 days),
which you accept when ordering those products. Risk in the goods passes to
you on delivery. Please ensure your delivery details are accurate; costs
arising from incorrect details you provide may be passed on.

## Installation and use

Our products are designed for professional installation. To the extent
permitted by law, we are not responsible for damage, costs or losses caused
by incorrect installation, improper vehicle coding, wiring modifications or
misuse, including labour and diagnostic costs incurred with third parties.
We strongly recommend installation by a qualified auto electrician or body
shop.

## Modification and tampering

Opening, disassembling, modifying or attempting to repair a product voids
our voluntary warranty and may lead to deductions or refusal of non-statutory
claims. This does not affect your statutory rights in respect of faults that
existed before the modification, though you may need to show the fault was
not caused by the work carried out.

## Returns, refunds and cancellation

Returns, refunds, the 14-day right of withdrawal, our RMA process for
suspected faults, and product-specific conditions are set out in our
[Returns, Refunds & Right of Withdrawal Policy](/pages/returns-refunds-policy).
That policy forms part of these Terms. Please contact us for a Return
Authorisation before sending back goods you believe are faulty — this keeps
the process fast and trackable.

## Chargebacks and disputes

If something is wrong with your order, please contact us first at
[returns@vmss.co.uk](mailto:returns@vmss.co.uk) — we resolve the overwhelming majority of issues
directly. We reserve the right to contest payment disputes that we believe
are unjustified, and to provide our payment processor with order records,
delivery confirmation, correspondence and these Terms as evidence.

## Road legality

Aftermarket lighting and body components may not be road-legal in every
jurisdiction or configuration. You are responsible for ensuring that
products are compatible with your vehicle and compliant with the laws,
type-approval and inspection requirements (e.g. MOT) that apply to you. We
accept no liability for fines, test failures or other regulatory
consequences of your use of the products.

## Intellectual property

All content on this website — text, images, logos and product descriptions —
is the property of VMSS LTD and may not be copied, reproduced or used
without permission.

## Limitation of liability

Nothing in these Terms limits our liability for death or personal injury
caused by our negligence, for fraud or fraudulent misrepresentation, or for
any other liability that cannot lawfully be limited. Subject to that, and to
your statutory rights as a consumer, we are not liable for indirect or
consequential losses (including loss of use or income, vehicle damage caused
by installation, or third-party labour and diagnostic charges), and our
total liability in connection with any order is limited to the price paid
for the products in that order.

## Indemnity (business customers)

If you purchase as a business, you agree to indemnify VMSS LTD against
claims, losses and expenses arising from misuse of products, improper
installation, violation of these Terms, or third-party claims related to
your use of the products.

## Messaging and email terms

By opting in to receive emails or messages from us: frequency varies with
your interaction with our services; message and data rates charged by your
network are your responsibility; you can opt out of marketing at any time by
replying STOP or using the unsubscribe link, after which we may still send
non-promotional service messages (e.g. order updates). Do not use our
messaging channels for unlawful or abusive purposes; we may suspend
messaging services in cases of misuse.

## Termination

We may refuse service, cancel orders (with a refund of amounts paid for
undelivered goods), or terminate access to the website where these Terms are
violated.

## Governing law

These Terms are governed by the laws of England and Wales. If you are a
consumer, you also benefit from any mandatory protections of the law of the
country where you live, and you may bring proceedings in your local courts.

## Changes to these Terms

We may update these Terms from time to time. The version in force at the
time of your order applies to that order.
